Terms of use
Last updated: October 2026 — Version 3.0
These Terms of Use apply to the services of Psychologist AI, operated by CEDIA Investigación y Desarrollo, S.L. (NIF B93806404, Av. Aragón 30, 46021 Valencia, Spain). Full company details are available in the Legal Notice.
1. Introduction and nature of the service
1.1. Description of the service: Psychologist AI is a technology platform that uses artificial intelligence to provide information, guidance and resources related to psychological and emotional wellbeing. We offer automated conversation services, educational resources and self-help tools based on recognised psychological principles.
1.2. Nature of the service — virtual wellbeing assistant: Psychologist AI acts exclusively as a virtual emotional wellbeing assistant supported by artificial intelligence technology. Its purpose is informative, educational and general wellbeing support. The answers, suggestions and recommendations provided are intended to complement and enrich the user’s knowledge of mental wellbeing topics, but in no case do they aim to, or can they, replace the professional judgement of psychologists, psychiatrists or any other duly qualified and registered mental health professional.
1.3. Not a medical or professional psychological service: Psychologist AI is NOT a medical service, a professional psychological service or a clinical diagnostic service. We do not provide medical diagnoses, professional psychological treatment, prescriptions or specific medical advice. Any information provided must be considered general educational guidance and not personalised professional advice or therapeutic treatment.
1.4. Artificial intelligence technology: our services are based on artificial intelligence algorithms that process information and provide automated responses. Although we use advanced technology and extensive databases, users must understand that this is an automated system with the limitations inherent in this technology, and that at no time are they interacting with a mental health professional.
2. What Psychologist AI is not and does not do
Express statement of limitations: to ensure a clear and unambiguous understanding of the scope of the service, it is expressly stated that Psychologist AI is NOT, does NOT carry out and cannot carry out any of the following activities:
| Psychologist AI is NOT… | Explanation |
|---|---|
| Clinical diagnosis | The system does not assess, diagnose or determine the presence of any disorder, illness or mental health condition. No response from the platform is a medical or psychological diagnosis. |
| Psychotherapy | No therapeutic intervention of any kind is carried out. Conversations have no therapeutic value and are not equivalent to sessions of psychology, psychiatry, clinical coaching or any other form of professional treatment. |
| Medical prescription | The platform does not prescribe, recommend or suggest medicines, doses or drug treatments of any kind. |
| Clinical risk assessment | The system does not carry out assessments of suicide risk, self-harm or any other clinical risk. In a crisis, the user must contact a professional immediately. |
| Therapeutic relationship | There is no therapeutic relationship between the user and the platform, or between the user and any professional. Interacting with the AI system does not create clinical rights or obligations. |
| Emergency service | Psychologist AI is not a crisis or psychological emergency service. It must not be used in life-threatening situations or psychiatric emergencies. |
| Expert evidence or report | The conversations and responses generated by the system are not valid as a psychological report, expert assessment, certificate or official document of any kind. |
2.1. Name of the service: for the purposes of these Terms of Use and any official communication, Psychologist AI is defined as an AI-based virtual emotional wellbeing assistant. The platform’s trading name is used for identification purposes only and does not imply the provision of regulated professional psychology services.
3. Access to and conditions of the website

5. Important limitations and safety recommendations
5.1. Emergencies and crises: in the event of a psychological crisis, suicidal thoughts, self-harm, thoughts of harming others, or any situation that requires immediate medical or psychological attention, the user must immediately contact the following services and must NOT continue using this platform:
- Emergency services: 112 or 999
- Samaritans: 116 123 (free, day or night)
- Text HELLO to 50808 (free text support, 24/7)
- Pieta: 1800 247 247

5.2. Express recommendation to consult a professional: we strongly recommend that any important decision relating to mental health, psychological treatment, medication or significant lifestyle changes is discussed with a suitably qualified and registered mental health professional. Psychologist AI may suggest when it is appropriate to seek professional help, but the final responsibility for seeking that help lies solely with the user.
5.3. Technical limitations of artificial intelligence: artificial intelligence systems have inherent limitations, including but not limited to:
- Limited understanding of complex emotional contexts
- Inability to detect non-verbal cues
- Lack of clinical intuition and practical experience
- Dependence on previous data patterns
- Possible misinterpretation of specific situations
- Inability to establish a real therapeutic relationship
- Responses may not reflect the latest scientific knowledge
5.4. Conditions that require immediate professional attention: users must seek immediate professional help if they experience:
- Suicidal thoughts or thoughts of self-harm
- Symptoms of psychosis or loss of contact with reality
- Substance misuse
- Severe eating disorders
- Recent trauma or post-traumatic stress
- Domestic violence or abuse
- Any condition that significantly interferes with daily functioning
6. Confidentiality of conversations
General principle: conversations held on the platform are strictly confidential. Psychologist AI undertakes to treat the content of users’ interactions with the highest level of privacy and protection, in accordance with the GDPR and the LOPDGDD.
6.1. Confidential nature of conversations: the content of the conversations that users hold with the Psychologist AI assistant is considered confidential information. No third party, whether an individual or a legal entity outside the technical operation strictly necessary for the service, will have access to the content of those conversations.
6.2. Restricted access — who can and cannot see conversations:
| Who | Access to content | Condition |
|---|---|---|
| The user | Yes | Always, from their authenticated account. |
| External third parties (people, companies) | No | Prohibited in all ordinary circumstances. |
| Psychologist AI operational staff | No | Staff do not routinely access the content of conversations. |
| Authorised technical team | Only under a strict protocol | Only in the specific cases listed in clause 6.3. |
| Competent authorities | Only when legally required | Only under a court order or valid legal request under Spanish law. |
6.3. Technical audit in the event of a platform incident: exceptionally and on a restricted basis, the authorised technical team of Psychologist AI may access the content of conversations only in the following cases:
Cases that allow a technical audit:
- Serious technical failures of the platform affecting the integrity, security or proper operation of the service.
- Security incidents or data breaches that require review to contain the damage and inform those affected.
- Critical errors of the AI system that may have produced potentially harmful or incorrect responses.
- Compliance with legal reporting obligations to the Spanish Data Protection Agency (AEPD) in the event of a security breach.
Safeguards of the audit process:
- Access will be restricted to technical staff with express authorisation and a justified need to know.
- An internal record will be kept stating the person, date, time, reason and conversation(s) consulted.
- Access will be proportionate to the incident: limited to the minimum necessary in scope and duration.
- The affected user will be notified as soon as technically possible, unless a legal duty of confidentiality temporarily prevents it.
- The information consulted will be subject to a reinforced duty of secrecy and may not be used for any purpose other than resolving the incident.
6.4. Use of data to improve the service: if Psychologist AI uses conversation data in anonymised and aggregated form to improve the models or the service, users will be informed and their prior express and unambiguous consent will be obtained, in accordance with Article 6 GDPR. Users may withdraw this consent at any time without affecting the lawfulness of processing carried out before withdrawal.
6.5. Deleting conversation history: users have the right to request the deletion of their conversation history at any time, without prejudice to any minimum retention period required by law. The request can be made from the account settings or by contacting support@psicologoia.ai.
7. Responsible use and user obligations
7.1. True and accurate information: users undertake to provide true, accurate and up-to-date information. The quality of Psychologist AI’s responses depends to a large extent on the accuracy of the information provided.
7.2. Personal, non-commercial use: the services are intended exclusively for the personal use of the registered user. Commercial use, resale or any form of commercial exploitation of the services is prohibited.
7.3. Specific prohibitions: it is expressly prohibited to use the service to:
- Obtain diagnostic or therapeutic information about third parties without their express consent
- Try to diagnose, treat or advise other people based on the information obtained
- Carry out illegal activities or activities that may harm third parties
- Impersonate others or deliberately provide false information
- Try to access restricted areas of the system or breach security measures
- Use the service in an automated or mass manner through bots or similar systems
7.4. Critical evaluation: users recognise the importance of critically evaluating all information received and undertake to check it against other sources where appropriate.
7.5. Responsibility for decisions: users acknowledge that they are solely responsible for the decisions they make based on the information provided by Psychologist AI.
8. Privacy and data protection
8.1. Applicable law: the processing of personal data is governed by our Privacy Policy, in full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).
8.2. Data controller: the controller of users’ personal data is the owner of the Psychologist AI platform, CEDIA Investigación y Desarrollo, S.L., whose full identifying details (company name, tax ID and address for notices) are given in the Legal Notice. For any question about data processing, please contact support@psicologoia.ai.
8.3. Processing of special category data — health data (Art. 9 GDPR): conversations held on this platform may contain information about the user’s emotional, psychological or mental health state. The GDPR classifies such data as a special category (health data, Art. 9.1 GDPR), which requires a higher level of protection.
The legal basis for processing this data is the user’s explicit consent (Art. 9.2.a GDPR), given freely, specifically, in an informed and unambiguous way at registration through a separate checkbox. Users can withdraw this consent at any time without affecting the lawfulness of processing carried out before withdrawal.
Psychologist AI does not use this data to make clinical decisions or diagnoses, and does not share it with health systems, insurers, employers or unauthorised third parties.
8.4. Data processor — Anthropic, PBC: to provide the AI conversation service, Psychologist AI uses the API of Anthropic, PBC (Claude model). Under Article 28 GDPR, Anthropic acts as processor of the data that users enter in conversations, while Psychologist AI acts as controller.
The relationship with Anthropic is governed by its Data Processing Addendum (DPA), which includes the Standard Contractual Clauses (SCCs) approved by the European Commission as the mechanism for international data transfers (modules 2 and 3). Anthropic undertakes to process the data only on the controller’s instructions and not to use it to train its models unless expressly authorised.
8.5. International data transfers: Anthropic, PBC is based in San Francisco, California (USA). Processing conversations may involve an international transfer of data outside the European Economic Area. This transfer is made under the Standard Contractual Clauses adopted by the European Commission (Implementing Decision 2021/914), included in Anthropic’s current DPA. Since August 2025, Anthropic has had infrastructure in several geographical regions (USA, Europe, Asia and Australia) to improve the reliability of the service.
8.6. Sub-processors: Psychologist AI informs users that the following main providers act as sub-processors in providing the service:
| Provider | Function | Location | GDPR safeguards |
|---|---|---|---|
| Anthropic, PBC | Processing of conversations (Claude AI model) | USA / multi-region | DPA + SCCs (Art. 46 GDPR) |
| Hosting provider | Platform infrastructure and hosting | See the Privacy Policy | Signed DPA |
| Payment gateway (Stripe) | Payment and subscription processing | USA / EU | DPA + SCCs |
| Email provider | Transactional communications and notifications | See the Privacy Policy | Signed DPA |
Users accept that Psychologist AI may use sub-processors to provide the service, provided they are subject to equivalent data protection obligations. If there are substantial changes to the list of sub-processors, users will be informed sufficiently in advance.
8.7. Data retention by Anthropic: under Anthropic’s policy for API customers, conversation inputs and outputs are deleted from Anthropic’s servers within a maximum of 30 days of being received or generated, unless a legal or technical exception applies (for example, if the conversation is flagged by abuse detection systems, in which case retention may be extended to up to 2 years). By default, Anthropic does not use API data to train its AI models.
8.8. Data retention by Psychologist AI: account data (username, email) is kept for as long as the contractual relationship lasts and, once it has ended, for the periods required by law. The conversation history stored on the platform is kept while the user keeps their account active, unless early deletion is requested. Billing data is kept for the period required by current tax law (at least 5 years).
8.9. Restriction on use by minors: the service is intended exclusively for people aged 18 or over. People under 18 may not register or use the service. Under Article 7 of the LOPDGDD, processing the data of children under 14 requires the consent of their parents or legal guardians. When registering, users expressly declare that they are 18 or over. If Psychologist AI becomes aware that a user is a minor, it will immediately close their account and delete their data.
8.10. Automated decisions: the service generates responses through automated processing of the information provided by the user. Under Article 22 GDPR, users have the right not to be subject to decisions based solely on automated processing that produce legal effects or significantly affect them. In the context of this service, the assistant’s responses are for information only and are not binding decisions. Users keep full autonomy over their personal decisions at all times. If a user wishes to request a human review of an interaction, they can do so by contacting support@psicologoia.ai.
8.11. User rights: users can exercise the following rights against Psychologist AI as data controller at any time:
- Access: obtain confirmation of whether their data is being processed and access it.
- Rectification: ask for inaccurate or incomplete data to be corrected.
- Erasure (“right to be forgotten”): ask for their data to be deleted when it is no longer needed for the purposes for which it was collected.
- Restriction of processing: ask for processing to be suspended in certain cases.
- Portability: receive their data in a structured, commonly used format.
- Objection: object to the processing of their data in certain cases.
- Withdrawal of consent: withdraw consent at any time, without affecting the lawfulness of earlier processing.
- Complaint to the AEPD: if they believe the processing does not comply with the law, they can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
To exercise any of these rights, users should write to support@psicologoia.ai stating the right they wish to exercise and attaching a copy of their identity document.
